Terms of Service

These terms are a contract between you and DifferApps ("DevPacs", "we", "us"). They cover the DevPacs mobile apps, the developer console at app.devpacs.com, and this website. By creating an account you accept them. If you don't, don't use DevPacs.

1. Eligibility and your account

You must be at least 16 years old to use DevPacs. You need one account, registered with a valid email address, and you are responsible for what happens under it. Don't share your login, and tell us promptly if you think someone else has access.

There is one kind of member. You can join a pack as a developer, bringing an app to be tested, or as a tester, providing feedback without contributing an app. Your role belongs to the pack, not to your account — you may be a developer in one pack and a tester in another. During early access, joining requires an app of your own.

2. How packs work

A pack holds up to seven members and runs for seven days. Day one starts at local midnight after the pack fills. Each day you receive one task for every other member's app in the pack. To complete a task you must open the app through DevPacs, spend a minimum period using it, and submit a screenshot together with a written response. Submissions are due by local midnight.

The developer who owns an app reviews the submissions on it and approves or rejects each one. If your submission is rejected you may dispute it once, with a note. Disputes are resolved either by another member of the same pack or by an administrator, and the decision is final.

Inactivity points. Missing a task adds an inactivity point; a day in which you complete everything removes several. Developers who leave submissions on their own app unreviewed also accrue points. At fifteen points you are removed from the pack, and you forfeit your entry fee and any tokens banked in that pack. This is how we keep packs functional for the people who do turn up.

3. Tokens

Tokens are a virtual, in-app currency used to join packs, post bonus tasks and export feedback, and are earned by completing tasks. New accounts receive a one-off grant of tokens.

You need to understand the following about tokens:

• Tokens have no monetary value, are not a currency, and are not your property.
• They cannot be exchanged for cash, redeemed, refunded, or transferred to another person.
• They are a limited, revocable, non-transferable licence to use a feature of DevPacs.
• Tokens earned during a pack are banked and become spendable only when that pack closes.
• We may change token prices and earning rates. We'll give notice in the app before a change to the rates takes effect.
• If your account is terminated for breaking these terms, any remaining tokens are forfeited.

4. Purchases and subscriptions

Token packs, subscriptions and inactivity-point clears are sold as in-app purchases through Apple or Google. They handle the payment; we never see your card details. Prices are shown in the app before you confirm.

Subscriptions renew automatically each month until cancelled, and you cancel through your Apple or Google account, not through us. Because token purchases are delivered immediately, they are not refundable by us; refund requests are handled under Apple's or Google's policies, and if you are a UK or EU consumer this does not affect your statutory rights.

You agree not to:

• Submit fake, recycled, automated or AI-generated proof, or feedback you did not genuinely produce by using the app
• Reject valid submissions to avoid paying out, or approve submissions you know to be fake
• Create multiple accounts, or coordinate with others to manipulate packs, tokens or disputes
• Harass, abuse, threaten or discriminate against another member
• Post illegal, infringing, malicious or sexually explicit content
• Attempt to breach, probe or overload our systems, or to access data belonging to others
• Use DevPacs to distribute malware, phishing, or an app whose purpose is to deceive
• Submit false reports or abuse the dispute system

7. If you bring an app

You confirm, for every app you add, that:

• You own it or are authorised to submit it for testing
• It is available at the store link you provide, and that link is accurate and current
• It does not contain malware, and it complies with the rules of the store it is published on
• It does not require members to disclose sensitive personal data or make personal payments
• You will review submissions on your app promptly and in good faith

DevPacs does not vet or endorse the apps in a pack. Testing an app is at your own discretion and risk, and your relationship with that app's developer, including their own terms and privacy policy, is between you and them.

8. Your content and feedback

You keep ownership of the screenshots, responses and feedback you submit. You grant DevPacs a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display that content for the purpose of operating the platform.

You also grant the developer of the app you tested a perpetual, irrevocable, royalty-free licence to use your feedback on that app to improve it, including after your account closes. Feedback given in a pack is meant to be acted on; you cannot require a developer to un-read it.

Developers can export the feedback on their own app. Once exported, that copy is outside our control.

9. Enforcement

Reports about members and tasks are reviewed by an administrator, who decides whether to uphold them. An upheld report can result in a note on the account, a formal warning, removal from a pack, or a permanent ban. Banned email addresses are blocked from joining new packs. We aim to apply this proportionately, and we may act without prior notice where a breach is serious.

10. Ending your account

You can delete your account at any time from your profile settings. Deleting mid-pack forfeits your entry fee and any tokens banked in that pack.

We may suspend or terminate your account if you break these terms, if we're required to by law, or if we discontinue the service. If we discontinue DevPacs entirely we will give reasonable notice in the app.

11. Disclaimers

DevPacs is provided "as is" and "as available". We do not warrant that packs will fill, that every member will complete their tasks, that the feedback you receive will be useful or of any particular quality, or that the service will be uninterrupted or error-free. Nothing here excludes liability we cannot exclude by law, including for death or personal injury caused by negligence, or for fraud.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, or for lost profits, lost revenue, lost data, or loss of goodwill arising from your use of DevPacs. Our total liability to you in any twelve-month period is limited to the greater of the amount you actually paid us in that period, or £50.

If you are a consumer, you have legal rights that these terms do not affect, and nothing in this section limits them.

13. App store terms

You obtained the DevPacs app from Apple or Google. Those companies are not parties to these terms and have no responsibility for DevPacs. Apple and Google are, however, third-party beneficiaries of these terms and may enforce them against you. Your use of the app must also comply with the applicable app store's terms of service.

14. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer resident elsewhere, you keep the benefit of any mandatory protections of the law of your country of residence.

15. Changes

We may update these terms. We'll change the date at the top, and where a change materially affects your rights we will notify you in the app before it takes effect. Continuing to use DevPacs after that means you accept the revised terms.
